CHNV Parole Program in Legal Limbo: What Employers Should Know Now

Last week, we shared a post titled “The End of the CHNV Parole Programs: What It Means for Manufacturers—and How Staffing Can Help,” outlining the Department of Homeland Security’s (DHS) decision to end the CHNV humanitarian parole programs and the looming expiration of work authorization for hundreds of thousands of individuals from Cuba, Haiti, Nicaragua, and Venezuela.

This week, the story took a major turn.

On April 14, 2025, U.S. District Court Judge Indira Talwani issued a stay to temporarily block the termination of the CHNV parole program, calling the decision by DHS a “Hobson’s choice” for individuals who have been living and working legally in the U.S. Under this expected judicial stay, parole and work authorization would continue—at least in the short term—beyond the original April 24, 2025 deadline. Judge Talwani emphasized that individuals affected by this program were following the law, and she questioned the fairness of stripping away their status without a path forward. While the final ruling is still pending, this development offers a measure of temporary stability for impacted workers—and the employers who depend on them.

What Employers Should Do Now

If your organization employs workers who entered under CHNV parole:

  • Continue treating these individuals as legally authorized to work. No changes should be made unless further guidance is issued.
  • Avoid taking any adverse employment actions based on speculation about future status.
  • Stay tuned for updates as the legal process plays out.
